Considering the legislation practice, defining the nature of real right, the author believes that real leasehold is usufruct of real property in nature. 綜合對各國關於不動產租賃權的立法實踐，釐清不動產租賃權的性質，對傳統的租賃權物權化進行批判，還原租賃權的物質本性，認為不動產租賃權是用益物權。
