Changing prosecution has not been stipulated in criminal procedure code of china.It is necessary to improve restricting system of changing prosecution by referencing others foreign way.

• 我国现行刑事诉讼法对公诉变更没有作出明确规定，有必要借鉴西方国家的做法，完善我国的公诉变更制约机制。
